Both Italy and the United States of America are states parties of the Aja Convention of December 5th 1961 which abolished the requirement of legalization for foreign public documents. According to the Convention, in fact, it is not necessary to have the diplomatic entities of both countries legalizing documents and certifications because this procedure has been replaced by the Apostille.

What is the Apostille?

The Apostille is a stamp and/or a seal placed on legal documents and/or certifications issued by foreign authorities to certify the authenticity in the country where these records have to be presented. In our case it can be the United States or Italy. In the United States, the competent authorities that issue the apostille seals are usually the state Secretary of State where the document has been released.

Italia e Stati Uniti sono entrambi membri della Convenzione dell’Aja del 5 dicembre 1961 sulla soppressione della “legalizzazione” sugli atti pubblici stranieri: in base alla Convenzione non è necessario che le Rappresentanze diplomatico-consolari dei due Paesi provvedano a “legalizzare” i loro documenti e certificazioni perché la loro legalizzazione è sostituita dalla cosiddetta “Apostille”.

Che cos’é l’apostille?

L’Apostille è un timbro/sigillo apposto su documenti e/o certificazioni rilasciati da autorità straniere al fine di certificarne l’autenticità e renderli validi nel paese in cui il documento deve essere prodotto: in questo caso, dagli Stati Uniti all’Italia e viceversa. Nel caso degli Stati Uniti, per quanto riguarda le apostille rilasciate dai singoli Stati, il sigillo è rilasciato dal Secretary of State dello Stato in cui è emesso il documento.
